State law requires employers who reported having an average of 5 or more employees in 2023 to register for CalSavers unless they meet one of the conditions for exemption:
- sponsors a qualified retirement plan, or
- closed or was sold, or
- company's classification is either a government entity, religious organization, or tribal organization
Employers will start receiving their official registration information by US mail and email in the Spring. If you believe your company is exempt from the mandate, submit an exemption request.
Registration/Exemption Deadline: December 31, 2024
If you preciously received a notice to register with a deadline in 2019, 2020, 2021, 2022, or 2023 then you may be out of compliance and must register immediately or face enforcement action.
In 2022, California passed legislation (SB 1126) to expand the CalSavers mandate to employers with at least one employee. Starting on January 1, 2023, employers with 1-4 employees (as reported to the EDD in the preceding calendar year), who are not otherwise exempt from participation, can register with CalSavers.
You may be exempt from the mandate if your company:
- sponsors a qualified retirement plan, or
- closed or was sold, or
- does not have any employees other than the owner(s), or
- is classified as either a government entity, religious organization, or tribal organization.
If you believe your company is exempt from the mandate, complete an exemption request.
Registration/Exemption Deadline: December 31, 2025.
If your company's exemption status changes before December 31, 2025, it may become eligible to participate. We will notify you based on our annual review of the employee data you submit to EDD.
